BEEnevolent Honey Bee Removal and Control Agreement

This Bee Removal Agreement outlines the scope of our services, responsibilities, and the terms that guide our work together. Our goal is to ensure transparency and peace of mind as we help resolve your bee-related concerns.

If honey bees have started a nest in your property, their removal or control is only the beginning of the process. Bees begin honey production very soon after establishing a colony. The honey and comb must be removed or they will begin to sour and ferment when the bees are gone and likely attract ants, roaches, rodents, or other pests. Frequently, structures must be opened in to successfully remove all comb. Once the bees and comb are gone, you will need to complete the repair of the area impacted by the nest and nest removal.


There may be more than one nest. If the various nests are identified during the removal of the current nest, the extraction of each additional nest is $500. If the various nests are identified after the removal of the initial nest is complete, the service charge is $1,000 for the removal.


SCOPE OF WORK

I authorize the BEEnevolent and its contractors to remove honey bees from my property.  


I understand it may be necessary to remove sheetrock, shingles, trim, walls, wall coverings, flooring, floor coverings, and other parts of the structure or to move furnishings in order to remove the bees, comb, and other bee related matter.


These holes may be in the living area, the exterior, or the roof, depending on where the bees have colonized. I understand once the removal is complete, I will have to repair any of these access holes at my own cost. Neither the named beekeeper(s), nor any association(s) they belong to, will perform or be responsible for any repairs or damage due to the disassembly that occurs during their removal efforts.


Repair to the property should be performed with the understanding that bees could return to the same location in the future and that all measures to prevent this should be communicated to the contractor used to repair the disassembly or damage done to the structure of the home. The Property Owner understands that the honey bee removal process may require multiple visits to complete. BEEnevolent and its contractors will make the best effort to complete the removal expeditiously. 


FEES


I agree to pay the BEEnevolent and its contractors for the removal services in the amount specified in the estimate. I agree to pay a $50 Consultation Fee for residential services OR a $100 Consultation Fee for commercial services that is required if I decide to forego BEEnevolent and its contractors removal services. I understand that the $50 Consultation Fee for residential services OR a $100 Consultation Fee for commercial services is credited with the procurement of BEEnevolent services.


I understand that the removal may require more than one visit across one or more days. I understand that this amount could change due to extenuating circumstances and that I will be notified prior to the extra work being performed. I understand that payment in full is due when the removal procedure is complete.


I understand that unresolved disputes, except for non-payment of fees, shall proceed to binding arbitration conducted in accordance with the construction industry rules of the American Arbitration Association, except that the parties shall select an arbitrator who is familiar with the related profession. The arbitrator shall conduct summary judgment motions and enforce full discovery rights as would a court and shall follow the substantive rules of law. BEEnevolent’s  liability for error and omissions in the execution of the scope of work is limited to a refund of fees paid.

STING HAZARDS

I understand some people may be moderately to severely allergic to bee stings. The reactions can vary from mild discomfort to a serious life threatening medical condition. More severe reactions include generalized swelling and itching, faintness, sweating, a pounding headache, stomach cramps or vomiting, a feeling of impending doom, a tight chest or choking sensation with swelling of the throat and in extreme cases anaphylactic shock with death resulting. I understand it is my responsibility to inform all surrounding neighbors so they can take the necessary precautions to protect their family, pets and livestock.


 I understand that 100% removal of all honey bees belonging to this particular colony may not be possible because a portion of the colony will be out collecting nectar and pollen. When these bees eventually return to the hive location to find their colony missing, they usually disperse within 24-48 hours. In order to attract these residual bees away from the cavity formerly occupied by the bees and to clean out any residual honey remaining in the cavity, BEEnevolent and its contractors may leave a beehive at the site for a day or two after the removal is complete. 


LIABILITY


I release BEEnevolent and its contractors from any liability pertaining to any damages caused by the honey bees or the extraction process. I give permission to BEEnevolent and its contractors to take whatever action necessary to remove the bees and honeycomb. I acknowledge that while utmost care will be taken to avoid damages, it may be necessary to obtain outside services at my expense to repair any resulting damages. The Property Owner relieves the BEEnevolent and its contractors of any liability should any person on or near the property receive a honeybee sting during or after the honey bee removal process and will take necessary steps to restrict access to the removal site.  


I understand and agree that BEEnevolent and its contractors may either disassemble the structure containing the honey bee colony or will cooperate with the Property Owner’s or his or her repairman as necessary to remove the honeybee colony. I understand and agree that BEEnevolent and its contractors will make the best effort to minimize damage to the structure. Any work to repair the damages related to the extraction process are not the responsibility of BEEnevolent. 


I understand and agree that BEEnevolent and its contractors will not perform repairs nor be held responsible for any repair work required resulting from the honey bee colony removal effort or from accidental damage. The Property Owner understands that all repairs are his or her responsibility. The Property Owner understands that his or her repairman performing the repairs must promptly seal up the cavity and cavity entrance properly to ensure that no other colony of honeybees will find and inhabit the same location in the future. It is the Property Owner’s sole responsibility to communicate this information to the repairman.  


The Property Owner understands he or she is urged to obtain an estimate of repair costs prior to the commencement of honeybee removal. BEEnevolent and its contractors will consult with the repairman as part of the paid service to ensure the repairman knows what the BEEnevolent and its contractors expect to do.  


BEEnevolent and its contractors have the right, at any time, to temporarily or permanently discontinue the extraction if any unforeseen obstacles, complications or health hazards that arise during the extraction process. 

RESPONSIBILITIES OF BEEnevolent AND PROPERTY OWNER


BEEnevolent Duties:

  • perform all removal work to the best of his/her ability

  • make every effort to cause the minimum amount of damage to the structure

  • remove as many bees and as much comb and honey as possible

  • advise property owner as to the best way to keep the bees from returning to the same area in the future

  • make a return trip to remove more bees if a significant number return

BEEnevolent does not guarantee that all bees will be removed due to bees still being in the field collecting nectar and pollen. Most bees that return to find the colony removed will disperse within 24 to 48 hours.


Property Owner Duties:


  • provide access to electricity and water, and accept sealed trash bags for disposal


HOLD HARMLESS AGREEMENT


I am fully aware of the risks involved and hazards connected with honey bees, and such a process required to remove them from the premises. I also understand and agree to hold harmless bee removal contractors and those assisting with honey bee removal from any claims, suits, actions or causes of action arising out of any injury, accident, or any damages that may occur in the process of removing the honey bees.
